Over the past few years, both the previous and current Boards have worked to revise our outdated governing documents that were originally written and filed with Harris County in 1993. The primary changes made were to bring our documents into compliance with changes made by the Texas Legislature, removal of outdated sections (such as the rights of the builder, mixed voting classes that no longer apply, …) and to split our Deed Restrictions into two parts, the Architectural Controls, and Deed Restrictions, in an effort to make them a little more user friendly.
At the 2013 Annual Owners meeting, the Owners passed the current revision of the Architectural Controls, with the sole caveat that it, and the updated Deed Restrictions would be reviewed by our Attorney. This process is complete, and has resulted in a number of changes that we have incorporated into both documents.
We are opening the public review and comment period for the proposed changes to both the Deed Restrictions and Architectural controls document today. The public comment period will close at the August 19th meeting of the Board. During this period, the Board will collect any comments or questions from our Owners, and will reply by posting an answer to the community website. If a question or comment result in a change to either document, the Board will make said change at the August meeting. The Board plans to announce a special Owners meeting in September. More on the special meeting will be announced as that date nears.
In the meantime, we are requesting that ALL Owners review these documents, and provide any questions or comments before August 19th by sending an e-mail to theboard@cypresswoodplace.com. When it is time to vote on these documents in September, the Board is looking for 100% representation of all our Owners, by in-person, electronic, or absentee ballots or via proxy.
There are two versions of each document available for your review, a “final” copy, and a “redline” copy. The final version is the document being proposed. The “redline” version was created by Microsoft Word, and shows each modification made to the documents. The Deed Restrictions redline version also includes some comments as to why certain changes were made. The changes to the Architectural Controls document were all made by the attorney, and therefore has fewer comments. These redline versions make the changes proposed as transparent to you as possible, as you can see each and every change being made.
